Diagnostics
neotes enables customers to undergo the following diagnostic tests:
bioAge Test
The bioAge Test is an epigenetic aging test designed to determine biological age and generate a personalized fitness and nutrition profile to support the optimization of the customer's health strategy.
Test Procedure:
After placing an order, the customer receives the test kit by mail. The customer then registers using the Kit ID included in the package. Following the enclosed instructions, the customer collects a blood spot sample (self-test), registers both themselves and the test kit online, and then sends the properly packaged sample collection card to the laboratory (Life&Brain, Bonn) in the prepaid return envelope. Approximately four weeks after the laboratory receives the sample, the analysis is completed and the customer's detailed bioAge Report is made available online by neotes.
The Premium Package includes, in addition to the collection of further health parameters, the opportunity to review the test results with a specialized longevity physician.
Gut Microbiome Test
The Gut Microbiome Test is based on DNA microbiome analysis and provides a detailed assessment of gut health with the aim of improving quality of life, particularly with regard to digestion, nutrition and body weight.
Test Procedure:
After placing an order, the customer receives the test kit by mail. Following the enclosed instructions, the customer collects a stool sample (self-test), registers both themselves and the test kit online, and then sends the properly packaged sample collection card to the laboratory (BIOMES NGS, Wildau) in the prepaid return envelope. Within approximately two to three weeks after the laboratory has analyzed the sample, the customer's Gut Microbiome Report is made available online by BIOMES NGS.
Longevity bloodAge Test (Hormone and bloodAge Test)
The Longevity bloodAge Test includes the measurement of more than 50 blood biomarkers, including hormone parameters.
The bloodAge Test measures age-related biomarkers to assess the body's overall health status based on more than 50 clinically relevant biomarkers.
Test Procedure:
When placing the order, the customer selects a referring physician located nearby via the website and subsequently schedules an appointment for blood collection. The referring physician sends the blood sample to the laboratory of the Hormonzentrum an der Oper in Munich for analysis.
After the laboratory has completed the analysis, the results are sent to the referring physician, who contacts the customer to arrange an appointment to discuss the bloodAge Test results and provide medical consultation. The physician may, where appropriate, make therapeutic recommendations and issue prescriptions. Such prescriptions are not included within the scope of the bloodAge Test product.
Omega-3 Test
The Omega-3 Test is used to determine the body's Omega-3 Index in order to assess whether the body is adequately supplied with DHA and EPA.
Omega-3 Test Procedure:
After placing an order, the customer receives the test kit by mail. Following the enclosed instructions, the customer collects a blood spot sample (self-test), then sends the properly packaged sample collection card to the Omegametrix laboratory in the prepaid return envelope and registers both themselves and the test kit as instructed. Within a few days after the laboratory has analyzed the sample, the customer's Omega-3 Report is made available digitally by Omegametrix.
NAD Test
The NAD Test measures intracellular NAD levels to determine whether interventions aimed at optimizing healthspan may be beneficial.
NAD Test Procedure:
After placing an order, the customer receives the test kit by mail and registers using the enclosed Kit ID. Following the enclosed instructions, the customer collects a blood spot sample (self-test) and sends the properly packaged sample collection card, at their own expense, to Jinfinity Inc. in the United States. The laboratory completes the analysis within approximately two weeks. Afterwards, the customer's NAD Report is made available online by Jinfinity Inc.
Micronutrients
Subject to availability, neotes also sells the micronutrient products offered on the website neotes.com.
BioCoach Program
The BioCoach Program is a holistic longevity program designed to improve medical parameters, replenish naturally occurring essential nutrients, reduce stress and lower biological age, thereby helping customers develop a personalized longevity lifestyle. The BioCoach Program is offered as a subscription service at the monthly prices published on the website. Depending on the subscription selected by the customer, different services are included. Customers may choose from three subscription plans:

The following optional services may be added to any of the three subscription plans:
The customer may voluntarily consent to the transfer of their health data, including data collected from wearable devices, to neotes' IT partner, Datarella GmbH, Oskar-von-Miller-Ring 36, 80333 Munich, Germany, in order to optimize the compilation and evaluation of personalized health information. Further details are provided in Section 12 of these General Terms and Conditions and in the separate Privacy Policy available on the neotes website.
Additional Consultation Services
Longevity Consultation
neotes offers customers the opportunity to book individual 25-minute longevity consultations during which the results of a bioAge Test Basic, together with other available health data where appropriate, are reviewed and discussed, including personalized recommendations.
Nutrition Consultation
Customers may also book personalized nutritional consultations with a qualified nutrition specialist. The service consists of three individual 45-minute consultation sessions.
III. Free Consultation
The free consultation offered on the neotes website is a non-binding introductory consultation only. No contract is concluded through this consultation, and these General Terms and Conditions do not apply to the free consultation.

Through its membership programs, neotes offers customers the opportunity to benefit from exclusive advantages designed for long-term customers.

III. Expert Membership
1 Scope
(1) These General Terms and Conditions (hereinafter referred to as the "Terms and Conditions") govern the legal relationship between neotes GmbH and its customers (hereinafter referred to as the "Customer(s)") with regard to the provision of diagnostic analyses presented by neotes GmbH on the website www.neotes.com .
(2) Unless otherwise agreed in writing, these Terms and Conditions shall apply exclusively. Any conflicting or deviating terms and conditions of the Customer are expressly rejected and shall not become part of the contract.
2 Customer Account Registration
(1) Customers may order diagnostic analyses through their customer account. However, creating a customer account is not a prerequisite for placing an order. Orders may also be placed using a guest checkout.
(2) Customers may register for a customer account on the neotes GmbH website (www.neotes.com). Registration requires the provision of the Customer's personal data and acceptance of these General Terms and Conditions. The version of the Terms and Conditions valid at the time of registration shall apply. Only individuals with full legal capacity are entitled to register. There is no legal entitlement to registration.
Upon registration, the Customer selects and receives a personal electronic account together with a corresponding password. The Customer must keep this password confidential and ensure that it is not accessible to or shared with any third party.
(3) Registration is free of charge. The Customer may terminate their customer account at any time. Upon termination, the customer account will be deleted by neotes GmbH. The Customer may update the personal data stored in their customer account at any time via the neotes GmbH website (www.neotes.com) using the electronic "Change Customer Data" form provided for this purpose.
3 Formation of Contract
(1) The presentation of diagnostic analyses on the website does not constitute a legally binding offer by neotes GmbH.
(2) By submitting an order through the neotes GmbH website (www.neotes.com), the Customer makes a binding offer to conclude a contract.
(3) Immediately after receipt of the order, neotes GmbH will send an email to the email address provided by the Customer confirming receipt of the order and summarizing its details (order confirmation). This confirmation merely acknowledges receipt of the order and does not constitute acceptance of the Customer's contractual offer.
(4) The contract is concluded only when neotes GmbH accepts the Customer's offer by issuing an order confirmation. The order confirmation is sent by email to the email address provided by the Customer.
During the ordering process, the Customer is required to complete a questionnaire necessary for the bioinformatic evaluation associated with the selected diagnostic test. The Customer may also voluntarily provide additional information enabling the physician to better interpret the test results within the context of the Customer's overall health.
4 Delivery Conditions
(1) Unless otherwise agreed, delivery shall be made to the delivery address specified by the Customer.
(2) All deliveries are made at the Customer's expense and risk. The risk passes to the Customer upon handover of the shipment to the carrier commissioned by neotes GmbH.
(3) Shipping costs are displayed together with the prices of the respective diagnostic analyses on the website and are shown separately on the invoice issued by neotes GmbH.
(4) All information provided by neotes GmbH regarding product availability, shipping or delivery represents estimated information only. Such information does not constitute binding or guaranteed dispatch or delivery dates.
5 Cooperation with Laboratories and Other Analytical Facilities
The laboratory or analytical facility responsible for performing the analysis depends on the diagnostic service purchased by the Customer:
For the bioAge Test, sample analysis is carried out by Life&Brain GmbH, Venusberg-Campus 1, Building 76, 53127 Bonn, Germany, on behalf of and under the responsibility of Age Labs AS, Gaustadalléen 23A, 0373 Oslo, Norway.
For the Gut Microbiome Test, sample analysis is performed by BIOMES NGS GmbH, Schwartzkopffstraße 1, Halle 21, 15745 Wildau, Germany.
For the Longevity bloodAge Test, laboratory analysis is performed by Kinderwunsch und Hormon Zentrum an der Oper, Lacher Puchta Pauer Michna PartG, Maximilianstraße 2a, 80539 Munich, Germany.
For the NAD Test, laboratory analysis is performed by Jinfinity Inc. 1235 Walton Way, Augusta, GA 30901, United States.
For the Omega-3 Test, laboratory analysis is performed by Omegametrix GmbH, Am Klopferspitz 19, 82152 Martinsried, Germany.
6 Consultation and Review Sessions with Physicians or Coaches
Where the purchased service includes a consultation or review session with a physician or coach, such consultation shall be conducted either remotely by telephone or in person.
7 Prices, Due Date, Payment Terms and Subscription Model
(1) The prices displayed in the shopping cart on the neotes GmbH website (www.neotes.com) include the applicable statutory value-added tax (VAT) as well as shipping costs. All prices are therefore final prices.
(2) For one-time purchases, the total purchase price becomes due upon receipt of the order confirmation.
(3) If the Customer subscribes to a subscription model (also referred to as a "Membership"), the applicable monthly subscription fee is payable at the beginning of each calendar month. Deliveries included in the subscription are generally made no later than the fifth day of the respective calendar month.
(4) Payment may be made by credit card or PayPal.
8 Retention of Title
All test kits supplied by neotes GmbH remain the property of neotes GmbH until full payment has been received.
9 Warranty Claims and Limitation of Liability
(1) The Customer's statutory rights in the event of material defects or defects of title shall apply unless otherwise provided below.
(2) neotes GmbH does not provide any guarantee regarding the quality or characteristics of the supplied test kits. In particular, product descriptions or test descriptions published on the website shall not constitute a guarantee.
(3) neotes GmbH shall be liable without limitation for damages resulting from injury to life, body or health caused by a breach of duty by neotes GmbH, its legal representatives or its vicarious agents.
(4) If the Customer chooses to have a blood sample collected by a physician of their own choice, such physician shall not be deemed an agent or subcontractor of neotes GmbH. Accordingly, neotes GmbH shall not be liable for damages resulting exclusively from acts or omissions of that physician.
(5) Where the Customer is responsible for collecting biological samples, the Customer shall ensure that sample collection is carried out in accordance with the instructions supplied with the test kit. neotes shall not be liable for damages resulting from improper sample collection unless such damages are caused by defective instructions or defects in the test kit itself.
(6) In cases of slight negligence involving the breach of a material contractual obligation, liability shall be limited to damages that were typical and reasonably foreseeable at the time the contract was concluded. Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract and upon which the contracting parties may regularly rely. This limitation shall not apply to the cases referred to in paragraphs (3) and (4).
10 Special Provisions for the BioCoach Program and Optional Coaching and Community Exchange Services (see Section C.)
(1) Either party may terminate a subscription with ordinary notice effective at the end of any calendar month. No reason for termination is required.
(2) The statutory right of either party to terminate the subscription for good cause without notice shall remain unaffected.
(3) As part of the BioCoach subscription, the Customer receives a supply of the micronutrients recommended by neotes based on the results of the diagnostic analysis. The quantity supplied corresponds to the recommended daily dosage for the duration of the subscription period.
(4) The optional coaching services and group experience exchange sessions are booked and invoiced separately. Any disruption or failure relating to these optional supplementary services shall, as a general rule, have no effect on the underlying BioCoach subscription.
(5) The availability of group experience exchange sessions depends on the availability of other participants. If neotes is unable to arrange a suitable group for the Customer within a reasonable period of time, the Customer shall be entitled to cancel the booking of the group session. In such case, any fees already paid for the group session shall be refunded in full.
11 Membership
(1) Membership may be terminated by either party at any time with effect from the end of the respective calendar month.
(2) The statutory right to terminate for good cause without notice shall remain unaffected.
(3) neotes is under no obligation to organize Community Events on a regular basis. Membership entitles the Customer only to participate in Community Events to the extent that such events are actually organized and offered.
(4) Priority customer support is provided exclusively in comparison with non-members.
12 Data Protection
(1) neotes GmbH collects, processes and uses the Customer's personal data exclusively for the performance of the contract and in compliance with the applicable data protection laws.
(2) By means of a separate declaration of consent, the Customer may consent to the processing of personal data by neotes GmbH and to the transfer of data to cooperating laboratories. Such data transfers are carried out in pseudonymized form.
(3) Where the purchased service includes a consultation or review with a physician or coach, the Customer may voluntarily consent, by means of a separate declaration, to the transfer of personal data to the respective physician or coach. Such transfer of personal data takes place without prior pseudonymization or anonymization.
(4) Participation in the BioCoach Program requires the Customer's consent to the transfer of personal health data to neotes' technology partner, Datarella GmbH, Oskar-von-Miller-Ring 36, 80333 Munich, Germany. Datarella collects the Customer's individual health data, including data generated by wearable devices used by the Customer, and makes this information available to the Customer and, where applicable, to physicians and coaches involved in providing the contracted services, in order to enable the most effective evaluation and implementation of the contractual objectives.
(5) Further information regarding paragraphs (1) through (4) can be found in the separate Privacy Policy available on the neotes website.
12 Governing Law, Jurisdiction and Final Provisions
(1) All contractual relationships shall be governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions shall remain unaffected.
(2) If the Customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising out of or in connection with the contractual relationship shall be Berlin, Germany, unless mandatory law provides for an exclusive place of jurisdiction elsewhere. In all other cases, the statutory provisions governing jurisdiction shall apply.
(3) Any amendments or supplements to these Terms and Conditions must be made in writing. This shall also apply to any amendment or waiver of this written-form requirement.
(4) Should any provision of these Terms and Conditions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
13 Online Dispute Resolution
The European Commission provides an Online Dispute Resolution (ODR) platform, which is available online. We are willing to participate in an out-of-court dispute resolution procedure before a recognized consumer arbitration body.

Right of Withdrawal
You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period shall expire fourteen days from the day on which you, or a third party designated by you who is not the carrier, acquired possession of the last item of goods. To exercise your right of withdrawal, you must notify us (neotes GmbH, Ziegelstraße 7c, 40468 Düsseldorf, Germany, Telephone: +49 (30) 440 39 720, Email: cs@neotes.care) of your decision to withdraw from this contract by means of a clear statement (for example, a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, although its use is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of your right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen (14) days from the day on which we receive your notice of withdrawal. Unless expressly agreed otherwise, reimbursement will be made using the same means of payment that you used for the original transaction. Under no circumstances will you incur any fees as a result of this reimbursement. We may withhold reimbursement until we have received the returned goods or until you have provided proof that you have returned the goods, whichever occurs first.
You must return or hand over the goods without undue delay and, in any event, no later than fourteen (14) days from the day on which you notify us of your withdrawal, to:

Your statutory warranty rights remain unaffected by your right of withdrawal in the event that the goods are defective.

10.1 Product Selection
Once you have found the desired product in our online store, you may view its detailed product description by clicking the relevant category button and the corresponding expandable buttons on the product page.
If you decide to purchase the product, you may add it to your shopping cart without obligation by clicking the "Add to Cart" button located at the end of the product description.
Alternatively, depending on the product presentation, you may add the product directly to your shopping cart without first opening the product description by clicking the "Shopping Cart" button.

10.2 Shopping Cart
You may view your shopping cart at any time by clicking the "Shopping Cart" button located at [describe button location], or by clicking the "View Shopping Cart" button located at […]. Once you click either the "Shopping Cart" button or the "View Shopping Cart" button, the shopping cart window will open. This window confirms that the selected product has been successfully added to your shopping cart. You will also be presented with x available options.
The second option allows you to change the quantity of products in your shopping cart or remove products from it. These options are located within the shopping cart information section. First, you will see an overview of the products currently in your shopping cart, allowing you to review and manage your selection. Below the last product, a summary of the total amount payable is displayed, including the purchase price and any shipping or payment-related charges for all products in your shopping cart.
